This Privacy Policy describes how FLY Yachts (“FLY Yachts,” “we,” “us,” or “our”), a yacht brokerage based in Fort Lauderdale, Florida, collects, uses, discloses, and protects personal information when you visit https://flyyachts.com (the “Site”), contact us, request that a broker call you, list a vessel with us, or otherwise interact with our services (collectively, the “Services”). It also explains the privacy rights available to you under the comprehensive privacy laws of U.S. states in which those laws apply, and how to exercise them.

By using the Site, you acknowledge this Privacy Policy. If you do not agree with it, please do not use the Site. This Policy should be read together with our Terms of Use, our Cookie Policy, and the Listing Disclaimer available in the Site footer.

1. Information We Collect

We collect information in three ways: directly from you, automatically when you use the Site, and from third parties.

Information you provide directly

  • Identifiers and contact details — name, phone number, and email address when you submit any form on the Site (for example “Request a call,” “Speak with a broker,” “Get a valuation,” a saved-search alert, or a listing inquiry).
  • Inquiry and transaction context — the vessels you ask about, what you tell us you are looking for, budget ranges you volunteer, notes you include in a message, and, if you engage us, information reasonably necessary to broker a vessel purchase or sale (which may include documentation, registration, survey, insurance, and payment-coordination details handled off-Site).
  • Seller information — if you list a vessel with us: vessel details, ownership information you provide, and marketing materials such as photos and video of your vessel.
  • Communications — the content of emails, texts, chats, and form submissions you send us. If calls are recorded or monitored, we will provide any notice required by applicable law.

Information collected automatically

  • Device and usage data — IP address, general location inferred from IP, browser and device type, operating system, referring pages, pages viewed, listings viewed, searches and filters used, saved and compared yachts, scroll and interaction events, session identifiers, and timestamps.
  • Cookies and similar technologies — cookies, localStorage, pixels, and analytics identifiers as described in our Cookie Policy. Non-essential cookies are used only as permitted by the choices you make in our cookie banner and preferences panel (“Cookie settings” in the footer).

Information from third parties

  • Listing data networks and central-agent brokers — vessel listing content displayed on the Site is largely supplied by third-party feeds and listing brokers; where a listing inquiry identifies you to a central agent or co-broker, we may receive related correspondence.
  • Advertising and analytics partners — aggregate or pseudonymous campaign and measurement data (for example from Google or social media platforms where we advertise).
  • Service providers — hosting, form, anti-spam, and communications vendors acting on our behalf.

We do not knowingly collect Social Security numbers, driver’s license numbers, financial account credentials, precise geolocation, biometric data, or health information through the Site, and we ask that you not submit them through Site forms.

2. How We Use Personal Information

  • To respond to you — including calling or texting you back at the number you provide when you ask a broker to contact you. By submitting a phone number in a “Request a call” or similar form, you consent to receive that requested call or text from FLY Yachts, including via mobile phone; message and data rates may apply; consent to marketing texts, where requested, is not a condition of purchase, and you may opt out at any time (reply STOP to texts or tell your broker).
  • To provide brokerage services — matching buyers with vessels, arranging showings and sea trials, coordinating offers and closings, and servicing seller listings.
  • To operate and improve the Site — saved yachts, comparisons, search, market-watch features, debugging, security, fraud and abuse prevention, and (with your consent where required) analytics that show us how the Site is used.
  • Marketing — sending you listings, market updates, or promotions where permitted, and measuring and improving our advertising (subject to your cookie choices and opt-out rights below). You can unsubscribe from marketing email at any time via the link in the message.
  • Legal and safety — complying with law, enforcing our terms, resolving disputes, and protecting the rights, property, and safety of FLY Yachts, our clients, and others.

We do not use personal information for automated decision-making that produces legal or similarly significant effects, and we do not knowingly process sensitive personal information except at your direction in connection with a transaction.

3. How We Disclose Personal Information

  • Service providers / processors — hosting and infrastructure, website analytics, session-experience tools, form processing and anti-spam, email and telephony, CRM, and marketing platforms, bound to use the data only to provide services to us.
  • Brokerage counterparties — when you inquire about a vessel that is centrally listed with another brokerage, or when a transaction proceeds, relevant details are shared with the listing broker, co-brokers, and transaction participants (for example surveyors, documentation agents, escrow, insurers, and lenders you engage).
  • Advertising partners — with your consent to marketing cookies, advertising platforms (such as Google and social media networks) may collect identifiers and activity on our Site through cookies and pixels to measure and personalize advertising. Under some state laws this is a “sale” or “sharing”/”targeted advertising” disclosure, and you may opt out as described in Section 6.
  • Corporate events — in connection with a merger, acquisition, financing, reorganization, or sale of assets, personal information may be transferred as part of the transaction, subject to this Policy.
  • Legal — to comply with law, subpoena, or legal process; to respond to lawful requests by public authorities; or to protect rights, property, or safety.

We do not sell personal information for money. We do not disclose personal information to unaffiliated third parties for their own independent marketing use without your consent.

4. Cookies, Analytics, and Tracking

Our cookie banner requests your choice before non-essential cookies are used, and the “Cookie settings” link in the footer lets you change your choices at any time. Categories: strictly necessary (always on — the Site cannot function without them), functional, analytics, and marketing. Details, including the specific technologies we use, are in the Cookie Policy.

Global Privacy Control. We treat a Global Privacy Control (GPC) browser signal as a valid opt-out: browsers sending GPC are automatically set to necessary-only cookies on our Site, which also functions as an opt-out of “sale,” “sharing,” and targeted-advertising disclosures made through cookies, as required by the laws of California, Colorado, Connecticut, Texas, and other states that recognize universal opt-out signals.

Where our tools support it, analytics and advertising tags are operated in a consent-aware mode so that they do not store or use identifiers for analytics or advertising purposes unless you have allowed those categories.

5. Retention

We keep personal information only as long as reasonably necessary for the purposes described above: inquiry and lead records for as long as needed to serve you and for a reasonable period afterward; transaction records as required by brokerage, tax, and maritime documentation obligations; marketing preferences until you change them; and technical logs for shorter operational periods. When information is no longer needed we delete, de-identify, or aggregate it.

6. Your Privacy Rights (All U.S. States)

Depending on your state of residence — including under the California Consumer Privacy Act as amended (CCPA/CPRA), the Virginia CDPA, the Colorado Privacy Act, the Connecticut DPA, the Utah UCPA, the Texas DPSA, the Oregon OCPA, the Montana CDPA, and other comprehensive state privacy laws as they take effect (including in Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Kentucky, Minnesota, Maryland, Rhode Island, Indiana, and Tennessee) — you may have the right to:

  • Know / access the personal information we have about you, including categories, sources, purposes, and disclosures;
  • Obtain a portable copy of personal information you provided;
  • Correct inaccurate personal information;
  • Delete personal information, subject to legal exceptions;
  • Opt out of (a) targeted / cross-context behavioral advertising, (b) “sale” or “sharing” of personal information, and (c) profiling in furtherance of decisions with legal or similarly significant effects (we do not conduct such profiling);
  • Limit use of sensitive personal information (California — we do not use sensitive personal information for purposes requiring this right);
  • Non-discrimination — we will not deny services, charge different prices, or provide a different level of service because you exercised a privacy right;
  • Appeal — if we decline a request, you may appeal by replying to our decision, and we will respond as required by your state’s law. If your appeal is denied, you may contact your state Attorney General.

How to exercise your rights

Submit a request through the Speak with a Broker form (choose “Something else” and mention “privacy request”), or call us at (954) 633-4878. To opt out of cookies-based sharing/targeted advertising, use Cookie settings in the footer (choose “Reject all” or turn off Marketing), or enable GPC in your browser. We will verify your request using the contact details associated with your information (for example by confirming control of the email address or phone number on file); an authorized agent may submit a request on your behalf with proof of authorization, and we may ask you to confirm the request directly. We will respond within the time required by applicable law (generally 45 days, extendable as the law allows).

California-specific disclosures

In the preceding 12 months we collected the following CCPA categories: identifiers (name, phone, email, IP); customer records (contact details and inquiry records); commercial information (vessels inquired about, saved, or compared; transactions); internet or similar network activity (browsing and interaction data on the Site); general (coarse) geolocation inferred from IP; and inferences (for example vessel-type interest) — from the sources, for the purposes, and with the disclosures described above. Categories “shared” (cross-context behavioral advertising) with advertising partners, when marketing cookies are allowed: identifiers and internet activity. Categories sold for money: none. We do not knowingly sell or share the personal information of consumers under 16 years of age. California residents may also request the names of third parties to whom we disclosed personal information for their own direct marketing (“Shine the Light”); we make no such disclosures. To opt out of sharing: use Cookie settings (“Reject all” or Marketing off) or GPC — this is our “Do Not Sell or Share My Personal Information” method, available on every page via the footer.

Nevada

Nevada residents may direct us not to sell covered information; we do not sell covered information as defined by Nevada law, but you may submit such a direction using the contact methods above.

7. Security

We use administrative, technical, and physical safeguards appropriate to the nature of the information — including TLS encryption in transit, access controls, hosting-level firewalls and monitoring, and vendor diligence. No method of transmission or storage is completely secure; if we become aware of a breach affecting your personal information we will notify you and regulators as required by applicable state breach-notification laws.

8. Children

The Site is intended for a general audience of adults and is not directed to children. We do not knowingly collect personal information from anyone under 16, and we do not sell or share such information. If you believe a child has provided us personal information, contact us and we will delete it.

9. Third-Party Sites and Content

The Site links to and embeds third-party content (for example listing media, maps, video, and social platforms). Those third parties handle personal information under their own privacy policies, which we encourage you to read. We are not responsible for the privacy practices of sites and services we do not control.

10. Do Not Track

Because there is no common standard for legacy “Do Not Track” browser signals, the Site does not respond to DNT; we do, however, honor the Global Privacy Control signal as described in Section 4.

11. Changes to This Policy

We may update this Policy from time to time. The “Last updated” date above reflects the current version; material changes will be posted on this page, and where required by law we will provide additional notice. Your continued use of the Site after an update constitutes acceptance of the revised Policy.
